Acceptance of Terms

By downloading, installing, or using Numerate ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

Description of Service

Numerate is a counter and goal tracking application for iOS. It allows you to create, manage, and track counters with features such as goals, streaks, history logging, widgets, and Siri integration.

License

Numerate is licensed, not sold, to you. Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, as permitted by the Apple App Store Terms of Service.

User Data

All data you create within Numerate is stored locally on your device. You are solely responsible for maintaining backups of your data. We are not responsible for any data loss resulting from device failure, app deletion, or any other cause.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices in the App
• Use the App for any unlawful purpose
• Distribute, sublicense, or transfer the App to any third party

Intellectual Property

The App, including its design, code, graphics, and content, is protected by copyright and other intellectual property laws. All rights not expressly granted are reserved.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses.

Apple App Store

Your use of the App is also subject to the terms and conditions of the Apple App Store. In the event of a conflict between these terms and the Apple App Store terms, the Apple App Store terms shall take precedence.

You acknowledge that Apple has no obligation to furnish any maintenance and support services with respect to the App.

Modifications

We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms. Material changes will be communicated through the App or this website.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
